1. Acceptance of Terms

By accessing or using Abendly ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Abendly is a proactive, read-only monitoring and diagnostic tool for IBM MQ environments. The Service continuously observes your MQ estate, surfaces findings and fix recommendations, and provides on-demand log analysis — all based on sanitized data that never leaves your network boundary.

3. User Responsibilities

• You are responsible for ensuring that logs are properly sanitized before submission. While Abendly provides client-side sanitization, you should verify the sanitized output before submitting.
• You must not submit logs containing classified, restricted, or government-sensitive data without proper authorization.
• You are responsible for validating all fix commands before executing them in production environments.
• You must maintain the security of your account credentials.

4. Disclaimer of Warranties

Abendly is provided "as is" without warranty of any kind. The AI-generated diagnoses and fix commands are recommendations, not guarantees. You are responsible for:

• Reviewing all fix commands before execution
• Testing fixes in non-production environments first
• Maintaining proper backups before making changes
• Consulting official documentation for authoritative guidance

5. Limitation of Liability

Abendly shall not be liable for any damages arising from the use of AI-generated fix commands, including but not limited to: system downtime, data loss, configuration errors, or security incidents. The maximum liability of Abendly is limited to the amount paid by the user in the 12 months preceding the claim.

6. Subscription and Billing

• Abendly offers free and paid plans. Specific plan details and pricing are provided during the sales process.
• Paid plans are billed via Stripe. Cancel anytime.
• Refunds are available within 30 days of purchase.

7. Intellectual Property

The analysis results generated by Abendly are yours to use, share, and distribute. The Abendly platform, knowledge base, and AI prompt structures are proprietary. Anonymous case fingerprints contributed to the global database are licensed under a shared commons model.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time by contacting support@abendly.io.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms.
